hereinafter referred to as the “Provider”
These Terms and Conditions (T&Cs) apply exclusively to all contracts concluded for the purchase of goods, services, or other products (hereinafter referred to as “Goods”) through the online shop at the above-mentioned URL. The version valid at the time of the conclusion of the contract shall apply.
Any terms or conditions proposed by the customer that deviate from these T&Cs shall not apply unless explicitly agreed to by the Provider in writing.
If the customer is a consumer, mandatory provisions of the law of the country in which the consumer has their habitual residence take precedence over these T&Cs where applicable.
The product listings in the online shop constitute a non-binding invitation to the customer to submit an offer to purchase the Goods.
A binding offer to purchase is made when the customer completes the order process via the Provider’s online order form and submits the order by clicking the order button. The Provider may accept the customer’s offer as follows:
The contract is deemed concluded at the time the first of these events occurs.
Before placing the order, the customer can review and edit their entries using the functionalities provided in the online order process. All entries are displayed in a confirmation window before the order is submitted and can be corrected at that stage.
The Provider will store the contract terms and send them to the customer in text form (e.g., via email) after the contract is concluded. Customers who place orders through a registered account in the online shop can access their order history and data in their account.
Contracts may be concluded in English only.
Consumers have a statutory right of withdrawal for contracts concluded at a distance or outside of business premises.
A “consumer” is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business, or profession.
Detailed information about the consumer’s right of withdrawal, including instructions on how to exercise it, will be provided to the consumer no later than immediately before the contract is concluded.
The prices applicable are those displayed in the online shop at the time of the order. Prices include the statutory VAT and any applicable shipping costs.
Payment methods available are listed in the online shop. Unless otherwise specified, payments are due immediately upon conclusion of the contract.
If payment by “advance payment,” “credit or debit card,” or “PayPal” is agreed, the purchase price is due immediately. Payment processing via PayPal is conducted by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg.
The Goods remain the property of the Provider until full payment has been received.
Deliveries are made within the timeframes indicated in the online shop to the delivery address provided by the customer.
Self-collection of Goods is not permitted.
If the Provider is unable to fulfill an order due to non-delivery by its supplier, despite having entered into a timely and sufficient agreement with the supplier, the Provider may withdraw from the contract. The Provider will notify the customer without delay and refund any payments already made.
The statutory provisions on liability for defects apply.
The Provider is fully liable:
In cases of slight negligence, the Provider is only liable for the breach of essential contractual obligations (cardinal duties). In such cases, liability is limited to the foreseeable, typical damage. Cardinal duties are those obligations that are essential for achieving the purpose of the contract.
Any further liability of the Provider is excluded.
The Provider processes personal data in accordance with applicable data protection laws. Details can be found in the Provider’s Privacy Policy.
The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This choice of law does not deprive consumers of mandatory provisions of the law of their habitual residence.
If the customer is a merchant, a legal entity under public law, or a special public fund, the exclusive place of jurisdiction is the Provider’s registered office. This also applies if the customer has no residence within the European Union.
If any provision of these T&Cs is deemed invalid or unenforceable, the remaining provisions shall remain unaffected.
The European Commission provides a platform for online dispute resolution (ODR), accessible at https://ec.europa.eu/consumers/odr.
The Provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
